Frequently Asked Questions

What is mediation?

Mediation is a voluntary, confidential process in which a neutral third party helps individuals discuss disputed issues and explore possible resolutions. Unlike litigation, mediation is non-adversarial and allows the parties themselves to remain in control of the outcome.

The mediator does not take sides, make decisions, or provide legal advice. Instead, the mediator manages the process, facilitates communication, and helps identify areas of agreement and potential resolution.

Who is mediation for?

Mediation may be appropriate for individuals and families who want:

  • A private and respectful process
  • A neutral environment to be heard
  • A more efficient and cost-effective alternative to court
  • Greater control over outcomes
  • A structured way to address high-conflict issues

Mediation can be voluntary or court-ordered and may take place before, during, or after litigation.

What should I expect in mediation?

Each mediation is unique, but the process generally includes:

  • An explanation of the mediation process and ground rules
  • An opportunity for each party to be heard
  • Structured discussion focused on key issues
  • Private breakout sessions when appropriate
  • Exploration of possible resolutions

No party is required to reach an agreement, and any resolution occurs only by mutual consent.

How does Deltoro Mediation ensure confidentiality throughout the mediation process?

Mediation is confidential as provided by Texas law. Communications made during mediation are not disclosed outside the process except as permitted by law. Participants are expected to attend mediation from a private location and not to record the session.
